LIMITED WARRANTY
J&P Lighting Solutions warrants to the original purchaser all new products, to be free from defects in material and workmanship, under normal use and service, for a period of 3 years from date of delivery. When warranty period expires, all such liability shall terminate. Materials claimed to be defective and covered by this warranty, at the discretion of J&P Lighting Solutions, must be returned to J&P Lighting Solutions, Krakow, Poland, prepaid, with a description of the defect. The parties hereto expressly agree that the Purchaser´s sole and exclusive remedy against J&P Lighting Solutions shall be for the replacement of a defective product or product purchase refund. J&P Lighting Solutions liability, whether under theories of breach of contract or warranty, negligence, or strict liability, shall be limited to replacing parts found by J&P Lighting Solutions to be defective or, at J&P Lighting Solutions option, to refund the purchase price of such product. THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE NOT EXPRESSLY SET FORTH HEREIN. In no event shall J&P Lighting Solutions be liable for incidental or consequential damages arising out of or in connection with a product or services sold by J&P Lighting Solutions. Consequential damages shall include, but not be limited to, loss of income or profit, loss of the products or any associated equipment, damage to associated equipment, cost of capital, cost of substitute products, facilities, services or replacement power, down time costs, or claims of buyer´s customers for such damages, from alleged negligence, breach of warranty, strict liability or any other theory, arising out of the use or handling of its products, and losses sustained as a result of injury (including death) to any person.
Limitation of Liability
PRICES ARE SUBJECT TO CHANGE WITHOUT NOTICE, EVEN AFTER AN ORDER IS PLACED, AND THIS WEBSITE WILL NOT BE LIABLE FOR CHANGES, OTHER THAN TO FULLY REFUND PURCHASES BEFORE DELIVERY.
